Review notes and outstanding decisions

Incorporated from #dob-radar: email-only login; phone is contact information, not verified or unique; the three confirmed paid tier names. The original draft already includes three-person sharing, no trial charges, monthly billing, no discounts and discretionary—not automatic—refunds.

  • Confirm the daily refresh statement, three-session enforcement, trial start time and reminder schedule against the implementation.
  • Section 13’s “only free access” sentence conflicts with the ongoing limited free account in Section 12. The original wording is retained for review.
  • Reconcile Section 18’s absolute refund wording with correction of billing errors and service-discontinuation refunds in Section 23.
  • Confirm the contact and effective date. Finalize the Privacy Policy and obtain legal review.

1. Who we are and what this agreement covers

DOB Radar is operated by DOB Radar LLC, a New York limited liability company. These Terms and Conditions govern your access to and use of the DOB Radar website, application, data, reports, and any related service we provide. In this document, "we," "us," and "our" mean DOB Radar LLC. "You" means the individual or business entity accessing the service.

By creating an account, starting a trial, subscribing, or otherwise using the service, you agree to these terms. If you do not agree, do not use the service.

If you are accepting these terms on behalf of a company, you represent that you have authority to bind that company, and "you" refers to that company and to every person you permit to use your account.

2. We are not affiliated with the City of New York

DOB Radar is a private, independently owned business. We are not affiliated with, endorsed by, licensed by, sponsored by, or connected in any way to the New York City Department of Buildings, the Environmental Control Board, the Office of Administrative Trials and Hearings, the Department of Housing Preservation and Development, the Department of Consumer and Worker Protection, or any other agency, office, or instrumentality of the City or State of New York.

We compile and present information that those agencies publish to the public. We do not act on their behalf and we cannot act on yours before them. Nothing you see on DOB Radar constitutes an official record, an official notice, or an agency communication.

3. Where the information comes from, and its limits

Substantially all information on DOB Radar originates from public records published by New York City agencies, primarily through the NYC Open Data platform. We collect that information, organize it, and present it in a format built for licensed contractors.

We do not create the underlying records and we cannot correct them. The accuracy, completeness, and timeliness of every record we display depends entirely on the agency that published it. Public records routinely contain errors, omissions, duplicate entries, outdated statuses, misspelled names, incorrect addresses, and records that were amended or resolved without the amendment being published.

Records are refreshed on a recurring cycle, ordinarily once every twenty-four hours. We do not provide real-time data and we do not represent that we do. A condition reflected on DOB Radar may have been resolved, dismissed, cured, appealed, transferred, or corrected since the record was published, and that change may not appear on our service for some time or at all.

City data sources experience outages, schema changes, publication delays, and interruptions entirely outside our control. During such periods the service may display incomplete information or no new information at all.

4. No warranty of accuracy; verify independently

The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, accuracy, or non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or secure, that defects will be corrected, or that the information presented is accurate, complete, current, or suitable for any purpose.

You are solely responsible for independently verifying any information before acting on it. Where a matter is important — a job you intend to bid, a property you intend to enter, a company you intend to contract with, a filing you intend to make — verify it against the official agency record before you act.

5. What the service is for, and what it is not

DOB Radar is a business intelligence tool for licensed trade contractors and general contractors. It surfaces publicly filed permits, violations, and license records so that you can identify potential work and understand activity in your market.

Open items displayed on the service are records of conditions reported by City agencies. They are not job listings, work orders, contracts, referrals, or guaranteed opportunities. We do not represent that any property owner, managing agent, or company wants work performed, intends to hire anyone, has budget available, or will respond to contact. Many open items are resolved, disputed, abandoned, or handled internally.

We do not broker work, guarantee outcomes, promise revenue, or represent that any subscriber will obtain any job, contract, or customer from using the service. Any figures we publish regarding market size, volume of records, or activity levels describe the underlying public data and are not projections of your results.

6. Not a consumer report; not for consumer-report purposes

DOB Radar is not a consumer reporting agency as defined by the federal Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq., or by any comparable state law. The information we provide is not a consumer report, an investigative consumer report, or a consumer credit report, and it is not assembled or evaluated for any of those purposes.

You may not use the service, in whole or in part, as a factor in establishing any individual's eligibility for credit, insurance, employment, housing, or any other purpose regulated by the Fair Credit Reporting Act. This prohibition applies regardless of whether the subject of the information is a business entity, a sole proprietor, or an individual, and it applies even where a business record identifies a natural person by name.

We do not publish reliability scores, safety ratings, risk grades, creditworthiness assessments, or any comparable evaluative rating of any company or individual, and you may not represent that we do.

7. License to use the service

Subject to your compliance with these terms and payment of applicable fees, we grant you a limited, non-exclusive, non- transferable, revocable license to access and use the service for your own internal business purposes during your subscription term.

We retain all right, title, and interest in the service, including the software, interface, design, compilation, organization, structure, derived data, reports, documentation, trademarks, and all associated intellectual property. Nothing in these terms transfers any ownership interest to you.

The underlying public records are not owned by us. Our compilation, arrangement, enrichment, and presentation of those records are.

8. Who may use your account

Your subscription may be used by up to three individuals, and up to three sessions may be signed in at the same time. Those individuals must be you and people within your own business — an owner, a partner, an employee, or a regular member of your staff. You remain the account holder and remain responsible for everything each of them does.

This permission does not make your account transferable. You may not give, sell, rent, lease, sublicense, or publish your credentials to anyone outside your business; make your account available to another company, a group, a crew you do not employ, or any list or forum; use your account to provide the service to third parties as part of your own product or offering; or exceed three individuals by rotating credentials among a larger group.

If you cease to be affiliated with any person who has used your credentials, change your password promptly. Notify us at the contact address above if you believe your credentials have been obtained by anyone not permitted to have them.

Concurrent sign-in attempts beyond three sessions may be refused. Activity that indicates use beyond three individuals — for example, sign-ins from a number of distinct locations or devices inconsistent with a three-person business — may result in suspension under Section 23.

9. Prohibited uses

You may not do any of the following, and you may not permit or assist any other person to do any of the following.

Share, sell, sublicense, rent, lease, or otherwise transfer your credentials or your access other than as expressly permitted by Section 8.

Use any automated means — including scraping, crawling, harvesting, bots, or scripts — to extract data from the service, or attempt to access the service other than through the interface we provide.

Resell, redistribute, republish, or commercially exploit data obtained from the service, or incorporate it into any product, database, or service offered to third parties.

Reverse engineer, decompile, disassemble, or attempt to derive the source code, structure, or underlying methodology of the service.

Circumvent, disable, or interfere with any security feature, access control, session limit, rate limit, or usage restriction.

Use the service to harass, stalk, threaten, defame, or intimidate any person, or to make any communication that is unlawful.

Use the service in violation of any applicable federal, state, or local law, including licensing laws, advertising and solicitation laws, and the laws described in the following section.

Misrepresent your identity, your licensure, your credentials, your affiliation with any agency, or your affiliation with us.

We may suspend or terminate access immediately, without refund, for any violation of this section.

10. Contacting people you find through the service; your compliance obligations

The service may display contact information, including telephone numbers, drawn from public records. That information is provided as published. We do not verify that any telephone number is current, correct, associated with the party named, or lawful for you to call.

If you contact any person or business you identify through the service, you are solely responsible for complying with all applicable laws governing that contact. These include, without limitation, the federal Telephone Consumer Protection Act and its implementing regulations, the federal and state Do Not Call registries, the federal CAN-SPAM Act, state telemarketing and solicitation statutes, and any applicable requirements regarding call time restrictions, caller identification, consent, recordkeeping, opt-out handling, and the use of automated dialing systems or prerecorded messages.

We do not obtain consent on your behalf. We do not scrub telephone numbers against any Do Not Call registry. We make no representation that any number displayed may lawfully be called by you, and displaying a number is not a representation that calling it is permitted.

Compliance is entirely your obligation, and it extends to every person using your account. You agree to indemnify us as provided in Section 21 for any claim arising from communications initiated through your account.

11. Your account

You must provide a valid email address and verify it to create an account. Each account holds one active subscription at a time and may be used by up to three individuals as described in Section 8.

Each account uses one normalized, verified email address as its login identity. Phone numbers are collected as contact and profile information only; they are not verified, are not required to be unique, and cannot be used to sign in.

You are responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account, whether or not you personally authorized it. Notify us promptly at the contact address above if you believe your account has been compromised.

You must be at least eighteen years of age and legally capable of entering into a binding contract.

We may refuse, suspend, or terminate any account at our discretion, including where we reasonably believe these terms have been violated.

12. Trial period

We may offer a trial period during which you may access the service without charge. Where offered, the trial period runs for thirty days from account creation.

No payment method is required to begin a trial, and no charge occurs at any point during the trial. A trial does not convert automatically into a paid subscription. If you take no action, your account converts at the end of the trial to a free account with limited access, and it remains that way unless and until you choose to subscribe.

If you choose a paid plan while your trial is still running, you are not charged at that time. Choosing a plan during the trial selects the plan you want and nothing more. Your first charge occurs when the trial period ends, and your monthly billing date is set from that day. Subscribing early never shortens your trial, never costs you any of your free days, and never results in a charge before the thirtieth day.

We will send reminders during the trial, ordinarily at ten days, twenty days, and twenty-nine days, so that the end of the trial does not arrive without notice.

Trials are limited to one per person and per business. We may modify, limit, or discontinue trial availability at any time. Modifying or discontinuing a trial offer never affects a trial already in progress.

13. Subscriptions, pricing, and billing

Paid subscriptions are offered in three tiers: Single Trade, General Contracting, and All Trades plus General Contracting. The price of each tier is displayed on the website at the time you subscribe. The price displayed is the price charged. We do not add fees, surcharges, or processing charges at checkout.

Subscriptions are month-to-month. Your first charge occurs when your paid period begins — at the end of your trial if you subscribed during a trial, or at checkout if you subscribed without one — and your subscription renews automatically each month on that same date until you cancel. There is no minimum term and no annual commitment.

We do not offer annual plans, multi-month plans, or prepaid terms of any length. Every subscription is billed one month at a time.

Payment is processed by a third-party payment processor. We do not store your full payment card details. Your use of the payment processor is subject to that processor's own terms.

We email a receipt for every charge.

We do not offer discounts, promotional codes, coupons, referral credits, or negotiated pricing. Every subscriber at a given tier pays the same published price. The thirty-day trial is the only free access we offer.

We may change our prices. Any price change affecting an existing subscription takes effect at a future renewal, and we will give you advance notice by email before it does. A price change never applies retroactively to a period you have already paid for.

14. Automatic renewal

YOUR SUBSCRIPTION RENEWS AUTOMATICALLY EACH MONTH AND YOUR PAYMENT METHOD WILL BE CHARGED EACH MONTH UNTIL YOU CANCEL. YOU MAY CANCEL AT ANY TIME THROUGH YOUR ACCOUNT, AND CANCELLATION TAKES EFFECT AT THE END OF THE PERIOD YOU HAVE ALREADY PAID FOR.

15. Failed payments

If a renewal payment fails, we will attempt to collect it and will notify you. You will have seven days from the date of the first failed attempt to provide a working payment method. That seven-day window is measured from the first failure and does not extend if subsequent attempts also fail.

If payment has not succeeded at the end of that window, your paid access ends and your account reverts to a free account. Your data and account are not deleted, and you may subscribe again at any time.

If the first payment at the end of your trial does not succeed, paid access does not begin and your account converts to a free account. Your trial is not extended.

16. Changing tiers

You may change your subscription tier at any time, in either direction, at no cost. Access changes take effect according to the rules published in your account at the time of the change. The new rate takes effect at your next billing date; we do not issue mid-cycle charges or mid-cycle credits when you change tiers.

We reserve the right to modify, consolidate, rename, or discontinue subscription tiers. If we do, subscribers holding an affected tier at that time will not have their price increased and will not lose access to any feature they held, for as long as they maintain a continuous subscription.

17. Cancellation

You may cancel at any time from within your account. Cancellation is self-service and does not require you to contact us, call anyone, or provide a reason.

Cancelling stops the next scheduled charge. It does not end your access immediately. You retain full paid access through the end of the period you have already paid for, after which your account reverts to a free account. Cancelling does not by itself entitle you to a refund of the current period.

Cancelling during a trial ends the trial and any plan you selected during it. No charge occurs.

If you change your mind before the period ends, you may reverse a scheduled cancellation from within your account at no cost and without re-entering payment information.

18. Refunds

We do not offer refunds. Cancelling does not produce one, and none is issued automatically in any circumstance.

We offer a thirty-day free trial precisely so that you can decide whether the service is worth paying for before any money changes hands. That trial is our evaluation period, and it takes the place of a refund policy.

If you nevertheless believe a refund is warranted, you may email us at the address above and describe the circumstances. We will read every such request and decide it individually. A refund is at our discretion, and where one is granted it will not exceed the amount paid for the current billing month. We do not refund prior months.

Whether or not a refund is granted, you retain access through the end of the month you have paid for.

A billing error — a duplicate charge, a charge after valid cancellation, a charge during a trial, or a charge in the wrong amount — is not a refund request. It is our mistake. Report it and we will correct it.

19. Field safety and assumption of risk

YOU ACKNOWLEDGE THAT ACTING ON INFORMATION OBTAINED FROM THIS SERVICE MAY LEAD YOU TO VISIT BUILDINGS, JOB SITES, AND PROPERTIES, INCLUDING STRUCTURES THAT ARE UNOCCUPIED, DISTRESSED, STRUCTURALLY COMPROMISED, UNSAFE, OR SUBJECT TO HAZARDOUS CONDITIONS. YOU ASSUME ALL RISK ASSOCIATED WITH ANY SUCH VISIT, ON BEHALF OF YOURSELF AND EVERY PERSON USING YOUR ACCOUNT.

We do not inspect, evaluate, or represent the physical condition or safety of any property appearing on the service. A record indicating a violation is not an assessment of whether a site is safe to enter, and the absence of a record is not an indication that a site is safe.

You are solely responsible for your own safety and that of your employees, for obtaining lawful authorization before entering any property, for using appropriate protective equipment, and for complying with all applicable safety regulations. Entering property without permission may constitute trespass, and we do not authorize it.

20. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITY, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID US IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WHERE AN ACCOUNT IS USED BY MORE THAN ONE INDIVIDUAL, THIS CAP APPLIES TO THE ACCOUNT AS A WHOLE AND NOT TO EACH USER.

Nothing in these terms limits or excludes liability for gross negligence, willful misconduct, fraud, or any other liability that may not lawfully be limited or excluded under New York law.

21. Indemnification

You agree to defend, indemnify, and hold harmless DOB Radar LLC and its members, officers, employees, and contractors from and against any claim, demand, action, loss, liability, damage, cost, or expense, including reasonable attorneys' fees, arising out of or relating to your use of the service, any use of the service by any person you permit to access your account, your violation of these terms, your violation of any law, communications with any person identified through the service, entry onto any property, or infringement of any right of any third party.

22. Privacy and data we collect

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. Do not use the service if you do not agree to it.

23. Suspension and termination

We may suspend or terminate your access immediately, with or without notice, if you breach these terms, if we are required to do so by law, if your payment is not collected as described in Section 15, or if we reasonably believe your use presents a risk to the service or to any other person.

We may discontinue the service in whole or in part at any time. If we discontinue the service entirely, we will give reasonable advance notice by email and will refund the unused portion of any period you have paid for.

Sections concerning intellectual property, prohibited uses, disclaimers, limitation of liability, indemnification, and governing law survive termination.

24. Changes to these terms

We may revise these terms. When we do, we will update the effective date at the top of this document and, for material changes, notify subscribers by email before the change takes effect. Continued use of the service after the effective date constitutes acceptance. If you do not accept a change, cancel before it takes effect.

25. Governing law and venue

These terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any action arising out of or relating to these terms or the service must be brought exclusively in the state or federal courts located in Richmond County, New York, and you consent to the personal jurisdiction of those courts.

26. Force majeure

We are not liable for any failure or delay caused by circumstances beyond our reasonable control, including acts of government, changes to or discontinuation of public data sources, failures of third-party infrastructure or payment processors, network or power outages, natural disasters, labor disputes, war, or civil unrest.

27. General provisions

These terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the service and supersede all prior understandings.

If any provision is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force.

Our failure to enforce any provision is not a waiver of it.

You may not assign these terms without our written consent. We may assign them, including to a successor entity or acquirer.

Nothing in these terms creates a partnership, joint venture, employment, agency, or franchise relationship between us.

Notices to you may be sent to the email address on your account. Notices to us must be sent to the contact address at the top of this document.
